1. Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of the AIAM platform (the "Service") operated by Orto Algorytmics sp. z o.o. ("AIAM", "we", "us"). By creating an account, signing an order form, or otherwise accessing the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of an organization, you represent that you are authorized to bind that organization.

2. The Service

AIAM is a multi-tenant, AI-powered software-as-a-service platform for multi-location healthcare organizations, with a primary focus on orthotic and prosthetic (O&P) practices and adjacent specialties. The Service includes practice-management modules and a Marketing Analytics Cockpit that aggregates performance data from third-party platforms the customer chooses to connect, including Google Ads, GA4, Search Console, email, SMS, and (in the future) Meta.

3. Eligibility and accounts

  • You must be at least 18 years old and legally capable of entering into a binding contract.
  • You are responsible for maintaining the confidentiality of credentials and for all activity under your account.
  • You must promptly notify us at hello@aiam.care of any unauthorized access.

4. Subscription, fees, and trials

  • Access to the Service is provided under a subscription described in an order form or online sign-up flow.
  • Fees are invoiced in advance and are non-refundable except as required by law.
  • Free trials, if offered, are subject to any limits stated at sign-up and convert to paid subscriptions only upon explicit confirmation by the customer.

5. Acceptable use

You agree not to:

  • Use the Service in violation of law, third-party rights, or these Terms.
  • Upload malware or attempt to disrupt the Service or other users.
  • Reverse engineer the Service, except as permitted by mandatory law.
  • Use the Service to send unsolicited bulk communications.
  • Bypass tenant isolation or attempt to access data of other Customer Organizations.

6. Third-party integrations

The Service can connect to third-party platforms such as Google (Ads, GA4, Search Console, Workspace) and Meta (Facebook & Instagram). These integrations are activated only when you explicitly authorize them via OAuth 2.0 consent.

  • Your use of third-party platforms is governed by their own terms, including the Google Ads API Terms of Service, the Google API Services User Data Policy, the Meta Platform Terms, the Meta Developer Policies, the Meta Business Tools Terms, and (where applicable) the Meta Lead Ads Terms.
  • You represent and warrant that you have the rights and authority to connect the relevant accounts, that you are an admin or otherwise authorized agent of the connected Ad Account, Page, Business Manager, or Google Ads account, and that you may lawfully allow AIAM to process the data returned by those APIs on your behalf.
  • You may revoke AIAM's access at any time in your Google Account, in Meta Business Settings, or by disconnecting the integration in AIAM under Marketing Hub → Settings → Integrations.
  • AIAM displays only data returned by these APIs. We do not modify, infer, or fabricate metric values, and we do not expose raw API responses externally.

6.1 Meta-specific commitments

When you connect a Meta account, AIAM:

  • Uses Meta Platform Data only to provide and improve features you have explicitly enabled.
  • Does not sell, license, or otherwise transfer Meta Platform Data to third parties for advertising or data-brokerage purposes.
  • Does not use Meta Platform Data to build user profiles for advertising outside the Meta platforms.
  • Honors deauthorization callbacks from Meta and, when received, schedules deletion of associated Meta Platform Data within 30 days.
  • For Lead Ads ingestion (where enabled): delivers lead submissions solely to the Customer Organization owning the relevant Ad Account and Page, never resells leads, and provides unsubscribe handling consistent with applicable law.

6.2 Google-specific commitments

AIAM's use and transfer to any other app of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements, as set out in our Privacy Policy.

7. Customer data and data protection

  • As between you and AIAM, you and your Customer Organization retain all rights in the data you submit or generate through the Service ("Customer Data").
  • You grant AIAM a worldwide, non-exclusive license to host, process, and transmit Customer Data solely to provide and improve the Service.
  • AIAM acts as data processor for Customer Data containing personal data, under the Data Processing Addendum incorporated into these Terms.
  • AIAM may use aggregated and anonymized data (which does not identify you or any individual) for benchmarking, analytics, and product improvement.

Our processing of personal data is described in the Privacy Policy.

8. AI features

Some Service features rely on artificial intelligence and machine learning. AI outputs are probabilistic and may contain errors; you are responsible for reviewing outputs before relying on them for clinical, financial, or operational decisions. Unless explicitly stated, AI features do not constitute medical advice.

9. Confidentiality

Each party will protect the other party's confidential information with the same degree of care it uses for its own confidential information of like importance (and at least reasonable care), and will use it only to perform under these Terms.

10. Intellectual property

AIAM and its licensors retain all right, title, and interest in and to the Service, including all software, models, designs, and documentation. No rights are granted except those expressly stated in these Terms.

11. Warranties and disclaimers

We will provide the Service with reasonable care and skill. To the maximum extent permitted by law, the Service is otherwise provided "as is" and "as available", without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

12. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Each party's aggregate liability arising out of or related to these Terms will not exceed the fees paid by you to AIAM in the 12 months preceding the event giving rise to liability.

13. Term and termination

  • These Terms remain in effect for as long as you use the Service.
  • Either party may terminate for material breach not cured within 30 days of notice.
  • Upon termination, your right to access the Service ends. We will make Customer Data available for export for 30 days, after which we will delete it unless retention is legally required.

14. Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be announced at least 14 days in advance via in-app notice or email. Continued use of the Service after the effective date constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Poland, excluding its conflict-of-laws rules. Disputes will be submitted to the exclusive jurisdiction of the courts competent for the registered seat of Orto Algorytmics sp. z o.o. in Kraków, Poland, without prejudice to mandatory consumer-protection rights of users in their country of residence.
